These terms apply to your visit to and use of pinnipedia.ai, including the contact form, the demo-booking flow, the platform tour pages, and any publicly-available documentation, blog content, or downloadable collateral.

They do not apply to the Pinnipedia platform itself. Access to Orbis Graph, paid subscriptions, trials, proofs of concept, and any delivery of consulting services are governed by a separate Master Services Agreement (MSA) plus a Data Processing Agreement (AVV) signed with each customer.

What you may not do

All content, features, and functionality on this website, including text, graphics, logos, diagrams, icons, product imagery, and source code, are the property of Pinnipedia Technologies GmbH or our licensors, and are protected by copyright, trade mark, and other intellectual-property laws.

You receive a limited, revocable, non-exclusive, non-transferable licence to view and use the website for your personal and internal business purposes. Any other use, including reproduction, redistribution, public display, or the creation of derivative works, requires our prior written consent.

Our liability for use of this website is limited as follows, consistent with § 309 No. 7 BGB and the established case law on standard business terms. Liability under the German Product Liability Act (Produkthaftungsgesetz), for fraudulent concealment of defects, and under any guarantee expressly given by us remains unaffected.

1. a.

   Uncapped liability

   We are liable without limitation for damages resulting from intent or gross negligence, for injury to life, body, or health, and under the German Product Liability Act.

2. b.

   Slight negligence of essential obligations

   For damages arising from slight negligence, we are liable only in the event of a breach of an essential contractual obligation (Kardinalpflicht), the performance of which is a precondition for the proper use of this website and on whose fulfilment you may reasonably rely. In such cases, liability is limited to damage that was foreseeable and typical for this kind of use.

   Other slight negligence

   Any further liability for slight negligence, in particular for indirect damage, loss of profit, or loss of data, is excluded, except where otherwise provided under (a) or (b) above.

4. d.

   Personal liability of our staff

   The same limitations apply to the personal liability of our employees, officers, representatives, and vicarious agents.

We may block, rate-limit, or restrict access to the website for any IP, network, or user-agent that breaches these terms, interferes with normal operation, or poses a security risk, at any time and without prior notice. This is a technical protective measure and is separate from any rights or obligations under the Master Services Agreement with our customers.

We may update these terms to reflect changes to the website, our services, or the legal framework. The current version is always published on this page, with the revision date shown at the bottom. Continued use of the website after the update constitutes acceptance of the updated terms.

These terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-laws rules.

For merchants (Kaufleute), legal persons under public law, or special funds under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these terms is Potsdam, Germany. We remain entitled to bring proceedings at your statutory place of jurisdiction.

Mandatory protective provisions applicable to consumers under the laws of the country in which you have your habitual residence remain unaffected.

If any provision of these terms is or becomes invalid or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a provision that comes closest to the economic purpose of the invalid one, in a legally permissible manner. The same applies to any gap in these terms.
